Please read these terms carefully. These terms define the legal relationship between you (the "Motor Carrier") and QuickConsent (the "Provider").
By accessing or using QuickConsent, you agree to be bound by these Terms. If you are using this service on behalf of a company (Motor Carrier), you represent that you have the authority to bind that entity.
You agree that electronic signatures collected via QuickConsent are the legal equivalent of manual signatures under the U.S. ESIGN Act of 2000 and UETA.
Audit Integrity: You acknowledge that our platform captures digital audit trails (including IP address, timestamps, and geo-location metadata) to verify the authenticity of the signature in accordance with FMCSA audit standards.
QuickConsent operates on a "Credit" basis. One (1) Credit is required to generate one (1) Limited Query Consent form.
Limited Query Only: This platform is designed strictly for "Annual Limited Queries" as defined in 49 CFR § 382.701(b).
• NOT FOR NEW HIRES: This service is NOT a substitute for the "Full Query" required for pre-employment. The Motor Carrier acknowledges that new hire consents must be conducted directly through the FMCSA Clearinghouse portal.
• DATA VERIFICATION: Note: QuickConsent captures the driver's signature, IP address, and device fingerprint. Verifying that the signing person matches the CDL on file is the Motor Carrier's responsibility. QuickConsent does not verify the identity of the person signing.
QuickConsent acts as a Generation Utility and Storage Assistant to help you maintain compliance.
As a feature of QuickConsent, we store your generated PDFs and audit trails on our servers for a period of 3 years (36 months) to align with FMCSA record-keeping mandates. You can access these via your dashboard.
While we provide this 3-year retention feature, the Motor Carrier is ultimately responsible for maintaining their local Driver Qualification File (DQF). We strongly recommend downloading and saving your files locally.
QuickConsent assumes no legal or financial liability if a PDF or record becomes corrupted, lost, deleted, or otherwise unavailable due to technical failures, cyber incidents, or service interruptions. The ultimate responsibility for maintaining regulatory records rests solely with the Motor Carrier.
Services are billed as one-time transactions via Lemon Squeezy (our Merchant of Record).
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any legal action shall be brought exclusively in the courts located within that jurisdiction.
